US Immigration help in London
« on: May 11, 2004, 09:48:21 PM »
All,

I am looking for professional, or extremely well-versed, help with my application for my return to the US.

Can anyone recommend a good lawyer, or other professional?

I am a UK born, British Citizen.  I spent 4 years in the US, legally, with a green card, after arriving there with a K-1 visa, and marrying my wife.

Due to a monumental mistake on my part, I allowed my green card to lapse.  As I was the wage earner of the family (we now have a 18 month old, dual citizen, daughter), we decided to come back to the UK, and have now been here for a little over a year.

We have now decided it is time to get back to the US, my wife misses it so, and we btoh feel it will be better for our daughter to be in the US as she grows up.

I think that is about the sum total of it all.

In short, we need to get my validated and able to work in the US in as short a time as possible, legally, of course.

Why is it that you feel you need professional help or an attorney? If (according to you) all you've done is let your Green Card lapse then reapply for a new one through the Embassy, you have'nt done anything wrong ???......the process takes about 3 months from end to end but this forum is loaded with information on it.....grab a beer, sit down and look around. There's plenty of knowledgable people here to help you out....Relax, you're in good hands here 8)

Ditto from what Celtic says.  I just posted what I found somewhere else on here.  Basically you have to reapply for the green card as a spouse all over again.   :P  You can try to prove hardship circumstances for why you were there for over a year, but unless you were there due to a sick/dying parent, working for the government or other such thing I am afraid you have to do the whole thing all over again.

If we decide to come back to the USA after my PhD (hopefully) we would be in the same boat as he just got his permanent residency.

So... I do think you can do this yourself, but if you do feel better with a lawyer there are plenty and hopefully someone can suggest someone to help you!

Good luck! Check out the REPAT board too!

If you feel you need legal help (I am so glad we hired an attorney who knew ALL the ropes) I can highly recommend Susan McFadden at Gudeon & Hoskinson. She's in London about 1 block from the US Embassy; is an American married to a Brit and I think she is the best immigration/visa attorney in London. (I interviewed a lot before we hired her). If you call her tell her Charlene & Ron from Jackson Hole, WY said Hi.

Well at least she must know the position her clients are in and how important he help is to them, her being an american married to a brit and all. that must be a huge plus if youre going to go for a lawyer.
