US citizenship/greencard for British spouse
« on: February 04, 2009, 07:32:41 PM »
I'm an American living in the UK with my English husband. Does anyone know if it is possible for him to aquire US citizenship or a greencard because he is married to a US citizen?  We don't have plans at the present to move to the US but may do so someday.

Not to mention, it would be to our benefit if we both held dual citizenship.

Thanks

He can't get a greencard until he actually goes to the US with a visa.

He can't get citizenship until he lives in the US for a minimum of 3 years(assuming you've been married 2 years at that point).

And to add to that list, a few forums which deal with UK to US marriage-based visas: visajourney.com, diveintoamerica.com and britishexpats.com.

you'll also find more info on this in the repat section, where i'm moving this. my husband got a green card after moving to the us with me 4 years ago. loads of paperwork, but really pretty fuss-free. just annoying, as all of these things usually are!
I'm done moving. Unrepatriated back to the UK, here for good!

If you have an ILR, the US has a reciprocal arrangements which makes your husband getting a visa to go to the US a lot easier.  Lots of paperwork as usual, but not as much hassle.

Will be the way we go in a couple of years so I've already done some research.

It only means that you will be able to file via the DHS unit of the US Embassy in London - the paperwork and requirements are the same whether you're able to file over here or in the States.

Also you don't have to have ILR to do this, I had FLR and we were able to do it in London through DCF

I just learned yesterday that in order to naturalize as a US citizen, your British spouse would have to give up their UK citizenship.

I never knew that.  I knew the US didn't recognize dual citizenship as such, but I didn't realize you had to renounce the country of your birth in order to naturalize.  Wierd.

I believe the UK takes the same view of that as the US does: it doesn't care what you tell another government. If you want to renounce, you have to renounce to them. So, even though in the US oath you have to promise to renounce other citizenships, UK still considers you one of theirs until you tell them you're not.

I think so, anyway.
And if you threw a party
Invited everyone you knew
You would see the biggest gift would be from me
And the card attached would say
"Thank you for being a friend!"

That's correct.

You're right. I'm a naturalised US citizen and still have my UK citizenship.

Well, that's a relief.  Not that we are planning on moving to the US anytime soon, but when DH mentioned that to me the other day I was quite surprised.  There is no way he would ever give up his UK citizenship, nor would I ask him to.

When you file, if you have been married for at least two years then the green card (ILR) is good for 10 years and can be renewed. If you are married under two years then the green card is valid for two years and then you fill out a form (90 days prior to the expiry) and get the 10 year green card.

I have a friend who is a permanent resident of the US and would like to apply for citizenship, but is afraid to give up his UK citizenship... I told him what has been shared in this thread, but he is still hesitant.  All the "official" information I can find online doesnt mention renouncing citizenship in one way or the other.  Does anyone have a link that explains the UK's policy on dual citizens and retaining UK citizenship?
