have an itin for hubby but do I need to use it?
« on: February 17, 2009, 09:39:40 PM »
Used hubby's income for the first year I filed. Got an itin number for him.  But now do not want to use his income as I have been working steadily.  Can I not use it now? Any help would be greatfully accepted.

I think you are saying you validly both elected to file a joint return by filing an election under section 6013(g).  If so, you can revoke that election by filing a revocation but could then never again file a joint return with the same non-resident alien spouse.

When I first moved over here I had some income and used money from an investment to buy our first home.  I was told it would be best to use both incomes on the 1040 form.  My state does not require me to file while I am not earning income in that state.  But I'm now a year or so behind on filing my 1040s and was wondering if I still had to put his itin on my 1040 as he is uncomfortable with putting his income down when he doesn't earn in the states and has no bank accounts or property etc in the states.  Or can I put resident alien where the itin would go?  Thanks guya for your help.
