Should I file 2555/Foreign Earned Income Exclusion
« on: May 19, 2009, 12:47:02 PM »
Please bear with me, I'm crap at this!  :-[ ;D

I'm a US citizen living in the UK for the past 5 years.  My husband is British.

I work for a UK-based company and make much less than the $87K threshold (around $50K).  Do I need to file 2555?  Or do I just file 1040 and claim 0 for my US wages?  I have a couple of bank accounts in the US but the interest earned on them is under $1000/year.  We do own a flat in the UK, but currently have no savings here.

Also, as far as I understand, my DH doesn't need to do anything - I just file as Married filing separately and list him as a non-resident alien?  He has a SSN and worked in the US for a period of about four years, but was on a work visa and returned to the UK in 2002.  He hasn't worked in the US since, but his name is on our US bank accounts (although I'm listed as the primary addressee).

Many many thanks!  :)

Your husband is doubtless reporting his share of the US bank interest on his UK returns.

You cannot claim an exemption for him as he has gross income in the US.

You must report worldwide income annually on US returns under penalty of perjury, whether or not you elect the foreign earned income exclusion.
