Hi,

My company has this annoying immigration consultant who I am not getting on with at all.  I have a question for you, but I will probably follow her advise anyways.

1.)  My company was bought out by another company. So half the year the bank statements says one company, the other half says another. It is equally reflected like this on the pay stubs. Yet the pay stubs are all still the same stationary.  Plus, you can tell it is the same company as the cumulative "net" annual pay still rolls in to add to the next month.  Same employee number, same cumulative accts, same company address, same font, same ugly blue paystub. This advisor says we need  a letter from HR stating that it is the same company.  What do you think?  (Mind you, I will probably do it anyways)

2.)  Maintainance of funds. I have the letter, it is stating a generous 25 Feb to 29 May maintainance of funds.  The actual letter was dated 1 June. This advisor is saying it may be problem because there is a gap in the day between when the letter is dated and what we requested the letter to say. well duh, it takes these people x days to fufill these requests. Not to sound snarky, but this is a bank we are talking about. Is she getting panicky over nothing? 

I think this woman is trying to win the Academy Award for immigration as opposed to just ensuring proper compliance. What do you think? 


PS  it almost doesn't matter as it is close to deadline and this is all I have to submit anyway...

More annoying lady update:

The advisor is saying, "Does this account still today meet the required minimum" .
Does it matter?  It doesn't say that it has to be every day even throughout at the time of the application submitted.
Or does it?  She already fought me tooth and nail that the 3 months have to be the most recent months. I disagreed in principal as it never says that in the guidance or application, but this lady is creating her own rules.   She says it has to be the most recent statement possible. What do you think?

Please Vicky, if you are here, your advice would be greatly appreciated.   :-\\\\ This woman is seriously wigging me out.

I am really sorry, but if there is another immigration advisor involved (who I would guess is getting paid) then I can't be.  Sorry.

I don't understand why the change of company matters.  Proof of earnings is proof of earnings.  It could be from several employments.  But I didn't read the guidance myself for change of employer so maybe she does know something about this.

The letter may be an issue actually.  Here is what the guidance says:

that the funds of £2,800 or £800 have been in the bank for at least three consecutive months on and immediately before the date of the letter. The letter must be dated no more than one calendar month before the date of application. We will not accept letters which show the balance in the account on a particular day as these documents do not show that the applicant holds sufficient funds for the full period needed.

The funds have to be there on and immediately before the date of the letter.  Since there is a gap, then I think there is an issue since the bank has not said you have the funds ON the date of the letter.

ETA:  Now that I think about the change of employer, you have to provide contact details in case they want to verify that the payslips you have given are correct.  I think at a minimum there, you would have to explain that the company was bought out.  If HR have to provide the letter to cross all the Ts and dot all the Is, it is really any skin off your back?

She is right here.  The guidance is very clear that it is the 3 most recent months, with the last month being no more than 30 days from the date of the application.

The phone number is on the letter. The money will be there. Can they call?

How do they ever know if the money isn't taken out immediately after an application is sent through?  I presume this because they probably call to see if the money is indeed still there.

Given we are talking of Tier 1 here (not Tier 2), I don't understand either.

Also, based upon what you have posted about your payslips, suspect it is not a change of company, but merely a change of name of the company.

Where is the company incorporated? If in the UK, go to the www.companieshouse.gov.uk website, and check it out. If I am right, you will be able to get up a screen detailing the change of name, and the date of change.

If the guidance says that funds need to be confirmed up to and including the date of the letter, I would say that is that.  I have known people to be denied a Tier 1 for a lot less.  I certainly wouldn't chance it and hope they just call the bank to confirm.  It is your job to provide what has been asked, not their job to make sure you have everything.

 I can get a letter from HR documenting company name change tomorrow.  Stupid, but I'll do it.

As for the bank, we just called and we are getting another maintainance letter. It includes the latest possible date and with using the same date on the top of the letter (letter date).  My sister will proofread it when she picks it up and Fed-Ex it over.

This is sad to say but thank god my sister is out of a job in the US and has time to chase down this for me and pick it up and FedEx. There is no other way I could have gotten it done and Fed-Ex ed so quickly.  And make my deadline as well. This has truly taken my whole work day and night and her day in the US.    Plus the worry and anxiety.  And its just one letter.

We need to start a club, the Tier 1 Survivors Party.  I'll bring the booze  [smiley=goofy.gif]
