Can My Credit Affect My Visa Approval
« on: August 25, 2009, 07:34:07 PM »
My husband and I have recently decided to file bankruptcy because we cannot sell our house and are planning on moving to UK.  We both had FICO scores in the 700s but that will soon change.  Our primary reason for filing is so that we can clear our debts before going overseas.  Does anyone know if that affects our ability to get spousal visa?

Hope it's not a stupid question, but just want to make sure!

There are no credit checks for UK spousal visas. So, no. And your credit history will not follow you to the UK, you get a fresh start.

You will, however, be required to include details of your bankruptcy on any future application for naturalisation as a British citizen, so make sure you keep copies of your paperwork as supporting documentation.

At the moment, bankruptcies discharged outside the UK are normally disregarded by the Home Office when evaluating your application on the basis of "good character" but there's no way of knowing how or when this might change....
