Marriage this year

Hi all,

It looks like the BF and I will get married on Dec. 30th. He is a UKC I live in the US.

So how does this affect my filing status?

Do I file as "Married, filing single"?

And does he have to file a US return?

Yes, married filing separately.

He is just a UK citizen?  He never lived in the US, or filed taxes before?  Then no, you can apply for him to get a number so you can file jointly (for instance you can't get the student loan tax benefit by filing married filing separately) but it seems like a bigger pain than it is worth.

Yup, he's 100% non US citizen. Has never lived here or filed taxes here. I'll be moving there (hopefully by March).

But getting married will not create a situation where he would have to file? Then I just file on my own and we are good?

No, he will not have to file.  You will write in the blank for Spouse's social security number NRA (for non-resident alien).
