Will previous K3 be a problem when filing for DCF?

My husband and I are soooo ready to go back to California and looking into DCF, but I've got a niggly little worry and I thought I'd post it on here, and I'm hoping someone will be able to answer it and quell my anxiety.

DH was married previously and over in the US on a K3 visa when I met him.  His ex never filled out the necessary forms for him to get his green card which is why we had to move over to the UK.  When we do eventually go through DCF will the K3 visa be a red flag?  By the time we apply it'll probably have been 2 and a half years since it expired.

I don't want them to think he's marrying Americans trying to get over to the US.  She kind of forced him to move over there anyway (lucky for him he liked it!).
