ILR outside immigration rules and the citizenship please help!!!
« on: November 02, 2010, 10:39:29 PM »
dear all
hello
im new to this forum and not sure where to post my question, but hope u will all comment on it.

my query is regarding my ILR through legacy and the background is:

i entered uk on a spouse visa in 2003.
applied for ILR in December 2003, which was refused in 2004. appealed aggainst the decesion but on hearing date on the recommendation from the judge n HO representing officer i withdrew my appeal n put a new FLR application in march 2005.
my marriage was dissolved in may 2003.

from march 2005 till june 2010 i didnt hear anything from ukba. in june 2010 i got a letter from ukba telling my case is in legacy and will be sorted n asked for my photos...i got my ILR in october 2010.it says ILR outside immigration rules due to my long residency n family connections in uk....

i met with my new wife in 2006, we are living together for over 2 years and a have a baby boy 11 months old. i applied for COA(certificate of approval) in sept 2009 and received it in sept 2009. and i just got married with a british citizen on 27th of october 2010.

so my question is :

when can i apply for citizenship?
can i apply now or have to wait for 12 months...

it says on the passport......type of permit=settlement

at the moment im really very much confused and seeking advice in this regard. please guys if u know about anything then please do comment.

thanx alot in advance
cheers

I don't think anyone here has the necessary knowledge to advise you.  I would suggest that you find a qualified immigration solicitor who has experience with outside-the-rules cases.  Good luck!

In *theory* the legacy book is *supposed* to be cleared by the time the Ministerial Statement on BCI expires.  That's why he picked the date two years in the future.  But then again, that was a different government.

Will it happen?  Who knows?

In your particular case, the UK's leading practitioner would arguably be  Mahmud Quayum.  He could tell you where you stand vis-a-vis the legacy book and whether or not you qualify.
