Foreign Tax Credit for UK Dividends?
« on: March 13, 2011, 09:22:42 PM »
I wonder whether any part of UK dividends paid to a US citizen residing in the UK can qualify for Foreign Tax Credit in the USA? It is my crude understanding that a corporation pays approximately 20% corporation tax on dividends, for which the recipient of the dividend effectively receives a 10% personal UK tax 'credit'--hence no UK taxes are due on dividends received if the individual is at the basic tax rate. This understanding leads me to suspect that the 10% personal UK tax credit related to dividends might qualify for a Foreign Tax Credit on a US tax return. Any informative replies are most welcome.

The IRS take the view that UK corporation tax is not a creditable foreign income tax.  Sorry!

Does anyone know about the "check the box" option and whether that is applicable to ownership of UK limited companies? My limited understanding is that this might be a way of getting the IRS to view the owner of a limited company as 'self-employed,' effecting a 'flow-through' tax situation, similar to the way the owner of an S-corp is taxed in the US.
