JSA & No Recourse (Question Answered)

I'm a bit confused about what a UK citizen would qualify for in JSA if their partner has no recourse.

I know that the UKC can claim benefits, but is unable to claim additional benefits for their spouse as they have no recourse.

However, is the 'no recourse' spouse's income included in the calculation of income for the claim? Or is it just the UKC income that is considered?

I've looked at policy documents on the DWP site and have done a few internet searches, but am still none the wiser.

Does anyone here know for sure?

The income of both partners is taken in account for a claim, regardless if one of the partners has no recourse.

They may have changed the rules since my ex claimed JSA (and I was on maternity leave so the rules might not have applied anyway) but I don't recall my income having any bearing on his ability to claim. Don't take that as gospel though.

They definitely look at both incomes now. My husband had to claim 6 months ago for a few months so not sure if that's recent enough to know the current rules but at the time they calculated it based on all money coming in. Including money that I made/had.
Met DH to be: 2004
Visited back and forth:2005-2008
Student visa: September 2008
Married: September 2009
Flr(m): July 2011
Finished my bachelors: May 2012
Finished MSc: august 2013
ILR approved: September 2013
Citizenship approval: August 2015
Passport received: November 2015
Citizenship journey is complete!

I've thought about this before, and if I have to claim JSA then I'll be arguing that if my wife has no recourse to public funds then I don't see why her income should be taken into account over my claim. They can't have it both ways.

Yep, my partner couldn't claim JSA because of my income.
Arrived as student 9/2003; Renewed student visa 9/2006; Applied for HSMP approval 1/2008; HSMP approved 3/2008; Tier 1 General FLR received 4/2008; FLR(M) Unmarried partner approved (in-person) 27/8/2009; ILR granted at in-person PEO appointment 1/8/2011; Applied for citizenship at Edinburgh NCS 31/10/2011; Citizenship approval received 4/2/2012
FINALLY A CITIZEN! 29/2/2012

I don't really see how the two are correlated to be honest.
If you're applying for the means-tested JSA, then it's means-tested. If you don't meet the requirements for it, then you shouldn't get it, regardless of where the household income is coming from.

DO you qualify for the first 6 months payment? Or are you passed that now?

He doesn't need to claim yet, but I don't think he'll qualify for contribution based because he hasn't paid NI contributions long enough. We'll see if we have to cross that bridge.
