Sorry about that Emmy. I can be dead harsh without meaning to be.

Hi all,

Just thought I'd let you know...  The consulate apparently hasn't even returned my $185 filing fee.  They kept the money order!  Even though they denied it on the basis of jurisdiction - NOT my eligibility - and therefore didn't even file the thing!  That's daylight robbery!

Anyone know the rules on this...?

Thanks

S.

I can kind of see their reasoning.  According to their rules (which, admittedly, are unwritten!) you applied too soon and as far as they're concerned, your wife wasn't in the UK on a spousal visa long enough before beginning DCF to establish residency.  So, if she hadn't established UK residency , she couldn't use DCF and her application was supposed to have to originated in the US...so they didn't have jurisdiction over her application.  Basically, she applied to the wrong office and they're penalising her for it.   :-\\\\

Hi all,

My lawyers got it wrong (they returned the application to them instead of us) and told me that the money order was kept...  The money order was in fact returned... :)

Thanks!

Emmy,

Quick question. Did you register with the U.S. Embassy on there website as residing abroad (in the UK)? Mine was turned down but I am wondering if that is the reason.

Seth
