file forms usa?
« on: January 09, 2013, 06:43:27 PM »
I would like to know what form I use to file my taxes in the USA for the time I have been in the UK please?

No fbar needed, no bank account in the USA.

Made very little here, but I want to file there... so, 1040EZ was what I used to use...

Is it a different form now?

I have no W2's or W4's. It is for 2012 taxes.

So confused... Do I need to check a special box or something so they know I was out of the country? What about state taxes?

Many thanks!

Married 04/13/11, in NYC.
Applied for Spouse Visa the following week, with express service, and I was approved 4 days later!
Arrived in the UK 05/20/11.
I took the stupid LIUK Test Oct. 2012.
We were granted ILR In Person in Croydon on 04/23/13.
Got BRP 2 days later, in mail box - it just appeared.

Check out Form 2555
You use this form: If you are a U.S. citizen or a resident alien.
• Earned wages/salaries in a foreign country.
• Had total foreign earned income of $95,100 or less.
• Are filing a calendar year return that covers a 12-month period.
And You:
• Do not have self-employment income.
• Do not have business/moving expenses.
• Do not claim the foreign housing exclusion or deduction.

Also the UK and the US have a tax treaty you will want to look into also

If you have any more questions just ask! :)

Each state has its own rules about whom it considers a resident and who is required to file a state tax return.

You are a little early as the IRS does not open for filing until January 30, 2013 so not all forms are available yet.

You have not mentioned what kinds of income you need to report.

Wages? Interest? Gambling winnings? Gifts from NRA spouse?

You'll probably have to file a 1040 along with either a 2555 to get the Foreign Earned Income Exclusion or a 1116 to claim credit on your 1040 for UK taxes you paid. You should check with NY if they still consider you a resident for tax purposes.

If you had over $10k total in foreign bank accounts you'll have to file an FBAR

Make sure you fill out 1040 Schedule SE with your 1040, that is the self employment form.

If you need help along the way just ask!

Thankfully Schedule SE is not required at all as you are covered for social security purposes under the UK National Insurance system.

Hopefully you are already registered for (and possibly paying) Class 2 NIC.

Perhaps you should meet with a dual US/UK qualified adviser face to face (there are several here in the UK) and have them do it the first year and you'll have a model you can follow for ever after until things become complicated again?
