Does claiming child benefit affect Citizenship?

Hi,

In a few years time I am planning to apply for UK citizenship.
Does claiming child benefit affect me in anyway from getting the citizenship?

Arrived as student 9/2003; Renewed student visa 9/2006; Applied for HSMP approval 1/2008; HSMP approved 3/2008; Tier 1 General FLR received 4/2008; FLR(M) Unmarried partner approved (in-person) 27/8/2009; ILR granted at in-person PEO appointment 1/8/2011; Applied for citizenship at Edinburgh NCS 31/10/2011; Citizenship approval received 4/2/2012

I know it's not what you asked but..

It can stop you getting ILR (if you don't have it yet) - so be careful!

The site says , Child Benefit can only be backdated for up to three months ...
So if I got my ILR, can I get the 3 months back or better not?

Is the baby's father live with you?  If so, is he subject to immigration control?

If he's around and not subject to immigration control, he can claim it.  That's what my husband does.

So is it correct that my (UK) husband should NOT have put my (US) daughter on the form when he did the child benefit paperwork for our (UK/US) son who was born here? We had a major argument about it at the time and it has all reared up again. He says that he (UK citizen) can claim it because he is supporting her. Whoever he talked to at Child Benefit office agreed and approved it. I am pretty sure he shouldn't be getting it and have been advised (by someone I trust on another board) to call and stop the benefit for the (US) daughter immediately and offer to repay. I tried to today but they wouldn't talk to me because, of course, it is in my husband's name. He doesn't believe me that this could potentially affect our ILR, coming up in a few months' time. Does someone have a direct experience with this?

Child benefit is a public fund.  Your daughter not entitled to public funds.

Correct me if I'm wrong...

The daughter isn't the claimant, thus she has broken no rules.  As long as the claimant isn't the person subject to immigration control then no rules are broken.

In this situation the UKC has claimed child benefit for a step daughter that he's responsible for.  No rules broken, no effect on ILR.

Seriously, don't worry about it, easy for me to say, I know, but you've broken no rules.

Child Benefit (CB) can be claimed by a
person responsible for a child, regardless of
whether the child lives with that person. The
claimant cannot be a ‘person subject to
immigration control’ (subject to exceptions –
see footnote) and must be present and
resident and have the right to reside here.
The child must also be present and resident
here. CB is classed as public funds. From
January 2013 a child benefit high earner
charge will be paid by a person or member
of a couple earning over £50,000.

So as long as the claimant (the UKC) is not subject to immigration control, then no rules are broken.

What is Child Benefit?
It's a weekly amount that parents of UK children can claim from the government to help with the cost of raising them. The amount they get is £20.30 per week for the first child and £13.40 for every other child in the household (the children must be under 16, or under 20 if in certain education or training). Not everyone is entitled to claim it though, for example, those on high incomes, or parents who are subject to immigration control etc. don't qualify for it.

I'm here on a spouse Visa and my husband ( British) was able to claim child benefit, we asked and 'NO' it will not affect you from receiving ILR or Citizenship.
