Hi there!

I've been reading IRS documents for a while now but I still don't have a clue as to what I need to do with my US taxes for this year.

I first came to the UK in Sept 2008 on a student visa and have been a full-time student here in the UK since then. Up until now I have been filing my taxes as a full-time student with no income at home in the US.

I got married to a UK national in May 2012, and I am now a resident of the UK on a marriage visa. My spouse's income is completely UK based, and I have had no income either US or UK based for the 2012/2013 tax year.

How do I file my taxes this year? My mother has received some advice from her US-based tax advisor that she can fill out my local and state taxes by simply writing on the form "full time student, resident in the UK". However when it comes the federal 1080-EZ, we are unsure how to fill this form out considering I am now married and now an official resident of the UK, although I still am a full-time student.

Can anyone give us some advice on how to fill out the federal 1080-EZ form?

On another note - when it comes to the 2013/2014 tax year, I will become employed here in the UK starting in the summer of 2013. My income shouldn't be more than £30,000, and my spouse's income shouldn't be more than £35,000 (both before UK tax). What forms will I need to fill out and how will I need to file for this next tax year?

I appreciate any advice you could provide, this international tax stuff is difficult!

Update:

I've been continuing to study the IRS website this morning (I thought sleeping on it might help me be not so confused).

I think I may have figured some things out but I still have a lot of questions.

Since I got married in 2012 and resided in the UK in 2012 tax year I'm pretty sure I need to file jointly with my UKC husband, and count him as a non-resident alien. I understand that this has benefits, especially if we ever consider moving back to the US at some point in the future? However my husband obviously doesn't have an SSN so do I have to go about getting him a temporary number for filing taxes?

For this application we'll need to fill out a 1040, the form for exemptions of foreign income, and also the form for declaring overseas bank accounts. Is this correct?

Do I still need to file state and local taxes? I'm from Pennsylvania originally - I don't own any property in that state, but I do have a driver's license and a bank account still active in PA. Does this mean I'm a domicile of PA, and still need to file state and local and apply for exemptions for foreign income there as well?

Also, my mother back home in the US is asking if she can apply with me as a dependent because I am still a full-time student. I don't think she can because I'm now married and I reside in the UK now, not in the US. Am I correct in thinking this?

I'm worried I may need to go down the route of paying someone to help me with filing, even just for this year so that they can actually help me understand what forms I need to fill out and how to fill them out, so that maybe next year I can attempt to do this myself! I'm so confused!

You'll need to file as married, filing separately. Your husband does not need to pay US taxes.

I'm not sure if PA still counts you as resident, but you can find those rules on the relevant PA website I'm sure.

Do I need to fill out the TDF90-22.1 for my own UK bank account and also for the bank account I own jointly with my husband?

I tried to file my federal and state taxes electronically but it wouldn't let me do so. Is this simply because I'm non-resident? Is there any way to file electronically or do I have to mail all of my filings?
