FLR(M)/UKBA - working away from home 5 days / week?
« on: November 21, 2013, 03:24:01 PM »
Hello,
I'm sure I've seen similar posts to this one, but not finding any presently.

Basically, I am here on an FLR(M), and I have taken to applying  for jobs in the London area as I've not been able to find anything in our area (far east East Anglia).
A prospect has come about, but would probably require I find a shared flat in London and be away from my spouse 5 nights a week.

My question is this - if I were to do this how would this look to the UKBA when the time comes to apply for my ILR? Would red flags go up? I do understand why it could be questioned, but how strict are they about this? If I say this job is all I could find in my profession and I NEED to work (both true) - and can provide documents (i.e., train tickets between my spouse and I, continued shared expenses like council tax/utilities/Sky TV, etc) would there be some leniency - or is all this a non-issue?

I know all the difficulties that could arise emotionally and physically from doing such a thing, but I'm strictly interested in the UKBA's outlook on this.

I would appreciate any feedback from those who have been through something similar - or have good information about it.

Thank you again UK Yankee forum!

I did something very similar when I was on my spousal visa, and it wasn't an issue for my ILR.  HOWEVER:

--this was four years ago, and there may be greater scrutiny if you are under the post-July 2012 rules.

--it was only for six months

--I maintained "residency" at the same address as my husband, and just rented a room during the week

I can't guarantee that it will be the same for you, but that was my experience.

Thank you for sharing your experience and information, historyenne!

I am under the old rules, and would maintain 'residency' at the address shared by my wife and I (and maintain bill payments!)

But in cases like this, it may be just left up to the discretion of the person processing the application. I feel as long as I maintain my share of the bills at our address, provide the travel documentaion for going to and fro to see each other, then it 'should' be ok.
But this job is also a three year contract, not six months.
