ILR for old rules spousal visa
« on: January 30, 2014, 06:28:43 PM »
So, I don't even know where to start! I am in the UK from the US on a "old rules" spousal visa and in August will need to start thinking about reapplying for ILR. All I can find in "new rules" info. Will I need to provide financials this time and what supporting documents do I need to provide? I know that I need to take the LIUK test prior to applying.

Please, any advice is greatly welcomed. Please point me in the right direction!

Thank you!
June 18th 2012- online application done and payed
June 22nd 2012- biometric done and paperwork sent
June 26th 2012- paperwork arrived NY
July 2nd 2012 - package opened
July 13th 2012 - phone call to confirm information
July 17th 2012- email to say my visa has been issued!

Control is not mine, it is His!

There shouldn't be much, if any 'new rules' information for ILR yet as no one will be applying for ILR under the new rules until July 2017 - new rules ILR doesn't exist yet.

All the information you need about applying under the old rules is here:
http://www.ukba.homeoffice.gov.uk/visas-immigration/settlement/applicationtypes/applicationformset%28m%29/

And all the documents you need to include are listed on the SET(M) application form:

There is no minimum amount.

You just have to show that:

a) The visa holder has not claimed or accessed any public funds in the 2 years

and

b) You have been and can continue to support yourselves without accessing public funds in the future.

Essentially, you want to show that you meet the same financial requirement as you did for your spousal visa:

That you have at least as much left over each week after rent and council tax (but before any other expenses) as a UK couple on income support would receive from the government.

For April 2013/April 2014, this amount is £112.55 for the couple plus £65.62 per child per week. In April 2014, it's increasing to £113.70 per couple and £66.33 per child - so just depends when you apply as to which amounts you need to show.
