Spousal Visa for US Citizen
« on: September 24, 2014, 01:16:40 AM »
Hi everyone,

Just got married in the US a couple weeks ago and I'm starting the process of applying for a visa to join my husband in the UK. I'm currently living in the US still.

Here's my questions:

1. When using the new Beta website ( newcomer link: https://www.visa4uk.fco.gov.uk [nonactive] ), I selected a "settlement" type of visa and then "wife." This seemed like the only option that made sense. When selecting the Sponsor details, it doesn't have an option for "husband" or "wife." It has a list of aunt, brother, cousin, daughter, father, friend, grandparent, mother, nephew, niece, sister, son, uncle, work colleague, and other relative. I chose the last one, "other relative." Did I select the wrong type of visa?

2. The application asks: "Is there any other information you wish to be considered as part of your application?" What kinds of things are helpful here?

3. The application asks: "Please Enter Details of what permission you have to stay in this country." Is this where I'd say, "My husband lives here"?

4. How long does it typically take to process US applications? Just curious.

5. Is this list of documents correct? Am I missing anything?
-2 passport photos
-current and old passports
-marriage license
-financial requirements documentation
-this form: newcomer link: https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/261405/sponsorship-form.pdf [nonactive]

Any advice about the new beta would be really helpful.

Thank you!
Jules

No, it's an error on the online form. You selected the correct visa.

Just select Other and if it lets you give details, put Spouse... otherwise you can correct it by hand after you have submitted the application and printed it.

Nothing, unless you have anything specific about your application you need to clarify. It's just the standard 'any other information' section... you can use it if you run out of space on other parts of the application.

Which country are they talking about? You don't have permission to stay in the UK, so you can't talk about the UK here.

If they mean the US, you say you are a US citizen.

It depends on how busy they are at the consulate.

Lately it's been taking 2-3 months, but you can pay $510 for priority processing and that's taking about 3 weeks.

You don't need that sponsorship form at all (it is not required for a spousal visa), but you are missing several documents.

You need to send:

Applicant
- Printed Online application
- Completed Appendix 2 form
- Biometrics appointment sheet which will be stamped when you attend biometrics
- Your passport
- Your previous passports
- 2 passport photos
- Sample itinerary for flight to UK
- Optional cover letter

Sponsor ID
- Passport or certified copy of passport photo page
- Letter of confirmation for the visa (sample here: http://www.londonelegance.com/transpondia/sites/default/files/spousal.pdf)

Finances

You need to work out which Category you can apply under as the required documents will depend on that:
https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/337420/Annex_FM_1_7_Financial_Requirement.pdf

Assuming Category A (your sponsor earns £18,600 or more in the UK and has been earning it, with the same company for 6 months):
- last 6 months of sponsor's original payslips and bank statements
- letter from sponsor's employer stating salary, length of employment, length of time earning current salary, type of employment
- sponsor's original P60
- sponsor's original job contract

UK accommodation
If sponsor owns:
- land registry document
- mortgage statement if he has a mortgage

If sponsor rents:
- tenancy agreement
- letter of permission from landlord for applicant to live there if they are not on the tenancy agreement

If you will be living with sponsor's family:
- land registry document
- letter from homeowner giving permission for you to live there and stating it won't be overcrowded
- mortgage statement if they have a mortgage

Relationship evidence:
- marriage certificate
- 1 or 2 photos of you together
- boarding passes from trips to see each other
- letters/cards sent to each other during your relationship
- screenshot of email inbox/Skype call log etc. showing regular correspondence for the length of your relationship

Thank you for clarifying all of that ksand24. I am also in a very similar situation. I am a US citizen, and my husband is from the UK. We got married a few weeks ago in the US and I am now applying for my spouse visa to go and rejoin him in London.

Could you explain where I find the option to expedite my application? Earlier posts all direct me to worldbridge to pay the extra fee, and include the receipt with my supplemental documents. However, the worldbridge site says it no longer has a connection to the UKBA. I am sure there must still be ways of paying to expedite my application, but the UKBA website (as usual) is not terribly clear.

Any help will be appreciated. Thanks!

Yeah, UKVI switched from Worldbridge to VFS Global as their commercial partner back in March 2014.

The direct link to the settlement priority service is here:
http://www.vfsglobal.co.uk/usa/user_pay_services.html

Just make sure you select the Settlement Priority Service for $510, not the regular one for $170.

I did the priority too. Let's hope it's worth it.

For the question of "is there any other info you want to include in the application" what I did was just explain our relationship - how we met, the different places we have lived together - just a few more details. It was all stuff that is on the application or appendix,  but they gave the space to add more info and so I just gave a few more personal relationship details. Additionally, there wasn't enough info on the form to list the countries I have been to in the last 10 years so I used this as space to list the rest. I think it's just a space that you can add anything in if you feel there is anything missing.

There isn't really any need to use the Additional Information section for this - most people either leave it blank or use it to complete any section there wasn't room for (i.e. travel history).

Your relationship only needs to be explained once - and that is in the sponsor's letter of support (plus the required details in Appendix 2) - and even then, it should be only a couple of sentences giving a general overview.

Totally understand - it was more for piece of mind for me. It was only a few sentences and we have had a lot of back and forth with moving. I think that the additional information section should/can be used for anything that someone wants to expand on/share - hence why I included the other countries I have been to in the last 10 years.

I was sharing on here, because I think it is fine to leave blank, but I think it's also a good space to include any other information that someone might want to share for their piece of mind (in my case - explaining in a few quick sentences how we met, why we have lived in different places). I don't think it harms anything to include a bit more! Literally a few sentences in exchange for my piece of mind.
