Fiancé to spouse, not going well
« on: October 16, 2014, 09:13:50 PM »
Hi,
I have a friend who had a long distance relationship with a Brit for about two years.
About a year ago, she moved across the pond and they married.
But things are not going well, AT ALL!
She's not sure what her rights are, if any.
Can someone comment?
She might have to go home, but she wants to stay and make a go of it.
Courage doesn't always roar. Sometimes it is the quiet voice at the end of the day saying:
"I will try again tomorrow"

He's basicly refusing to support her while she looks for a job. She is in her fifties, and it's not easy to start over in a foreign country with no UK references.
She's having to borrow money from her family just to buy groceries.....

It depends on the visa that she is on right now.  It appears that she would be on a spousal visa, and so she would not be able to stay in the UK if the marriage has broken down.

If the relationship has broken down, and she does not have ILR, unfortunately she must  return to the US or find another visa to qualify for that would allow her to remain in the UK.
