Emergency regarding Payslips!!!!!!
« on: December 11, 2017, 06:26:46 PM »
My husband who is the sponsor has gotten the covering letter from his employer that confirms his employment, start date, salary and so on. His payslips are sent online, he has printed them for the last 6 months and told them that we need a declaration stating that the payslips are genuine.

Well.... his direct manager refused to sign the paper saying "who is to say that you won't change the numbers after I've signed it", (!!!!!)  H.R has said that they've already confirmed everything else and that the payslips don't need to be verified that they are genuine and it's of no relevance!

I'm so pissed right now, we don't know what to do, he works for a very prominent global internet company and they are treating us like this. He's an infrastructure engineer, and has put in years with them! We had no problems last time his old director just signed it and kept on.

I don't know what to do, we have the bank statements that show when he was paid that would correspond to the payslips, should we just send it and hope for the best?

Please help!

Tell him to include the amount of each payslip in his verification letter, that takes care of his objection.

Sorry you're having so much trouble with it.

Unfortunately, it's a requirement that the payslips must either be originals printed by the company, or they must be accompanied by a letter from your employer confirming their authenticity.

Can they not just add a sentence into their main letter confirming this, rather than signing a 'declaration' (which is not really what they are supposed to do - they are supposed to write a letter themselves and then sign it).

Alternatively, can they issue you with official payslips instead?

From Appendix FM-SE:

Quote
bb) Payslips must be:
(i) original formal payslips issued by the employer and showing the employer’s name; or
(ii) accompanied by a letter from the employer, on the employer’s headed paper and signed by a senior official, confirming the payslips are authentic;

https://www.gov.uk/guidance/immigration-rules/immigration-rules-appendix-fm-se-family-members-specified-evidence

Edited to add:

larrabee's suggestion to have them add the amount of each payslip to the letter is a good one :).

Ugh! I just had this happen as well! I went round and round with the HR manager until I suggested this to her and I finally got my letter. Good luck.

You could also probably point out that you already qualify and you know you already qualify based on his actual income, so there is no reason for you to change anything.  Show them the income requirement and how much the payslips amount to, and they can hopefully see the logic behind it.

Just an update, my husband called the head of H.R himself and told him how imperative this was and that it was an absolute must, or my visa will be denied and I could be deported because of this reason.

So after this, he agreed to give us the declaration, via email in the next 20 mins, it's not a wet signature as it's printed through an email, but that should be alright? Right?

Also, it doesn't matter if one document is done via a color ink and the other isn't? At home we ran out of color toner. Lol

It really should be a wet signature.  Are they able to pop the letter in the post to you today as well as the email?

If not, you'll just have to go with it.

We had a similar issue with our payslip letter, my Husband explained to his manager the situation and why we needed it. He also showed him the guidelines on the website so they eventually agreed to write a letter just saying that they are attached and genuine.

I hope you can get it sorted, I feel for you getting all these documents can be sooooo stressful!!

My husband and I are having a similar issue with payslips. He never sees his manager and the HR office for his company is in Newcastle, whereas he's in London. He ended up having to send PDFs of his payslips to HR and request they send the letter in the mail. Today he received an e-mail that they've sent it. Hopefully everything will be correct. It is very frustrating though, as we had planned on applying in October.

I think the idea to include the amounts of each of the payslips in the letter before he signs it is a good one.

I didn't get my online payslips countersigned and my wife was approved. All mine are online and I printed them off (12 months worth along with 3 years of P60s) and did not realize you had to get a letter confirming that they are genuine. So all I sent was the printed off payslips and an auto-generated letter from my company confirming my salary and start date.

And I only included 3 months of bank statements!

Wow! I remember congratulating you when your wife's visa was approved but I had forgotten that you had only included 3 months of bank statements. And they didn't ask for them? Presuming they didn't, it was a regular Christmas miracle that she was approved! You were VERY lucky!  ;D

Indeed! I wonder if their systems are much better integrated, and they can see a few along with a letter from the employer, pull up the tax records from HMRC and call it good? I'm guessing they would be able to see a good detail of employment history from that. Sounds like something I wouldn't want to leave to chance :)

Yeah, I mean, we've seen people refused for applying just 1 day before the end of the required 12 months for their Category, and we've seen people refused for not including the entire 6 or 12 months of payslips and/or bank statements.

Not something you would want to leave to chance indeed! They want you to jump through all of their hoops so you must provide all of the evidence they ask for.
For example not including the sponsor's passport got someone refused recently. The passport number was given, it could obviously have been looked up but UKVI said they didn't believe the sponsor was British so refused the visa!

So do we need the actual passport or can the sponsor just send a photo copy of said passport?
