Visa4uk site Employment Section
« on: June 23, 2018, 02:47:12 AM »
Hi,
I'm a US citizen who is married to a British citizen. Completing the application on the visa4uk site for settlement>> wife. The employment section is before the "Sponsor Details" tab. Which makes me believe the applicant is to fill it out. Further down is the tab for "Sponsor Details" which doesn't ask for any employment information. Considering my employment in the USA is irrelevant for a spouse visa, would I answer "What is your current working status? As "Supported by Sponsor/Partner/other?" Otherwise, if I answer it as "full-time" then it wants pay and employment details. Or would I input my spouse/sponsor's employment details?

Thank you,

Sarah

You need to put your employment information and all the details in the online form. As you say, it’s not relevant for a spousal visa, but it is a requirement to fill it out with your information.

You do not need to provide any evidence of your employment, it’s just that the online form is generic and similar for all visa types, so some of the questions aren’t particularly relevant for a spousal visa, but you must still answer them (like when it asks how long you intend to stay, you can put ‘permanently’ or ‘indefinitely’).

Your sponsor’s income must then be filled out in the VAF4a Appendix 2 form, which is the second half of the spousal visa application form and contains all the questions about how you meet the requirements for a spousal visa, namely:
- relationship requirement
- accommodation requirement
- financial requirement category

You will need to print out Appendix 2 and fill it in by hand:

Hi Sarah!  :)

Be sure not to submit the online application until you are absolutely sure you have all of your supporting documents ready to be sent to Sheffield.
If you would like to list here what you are planning to submit, we can check it over for you to make sure you have everything you need!

Hi Again.

Questions from the online form:

1.) Name change date: are people using their wedding ceremony date or the Local Registrar "Date Accepted for Registration" (in my case it is the day after the ceremony date) that's near the bottom of the official License and Cerificate of Marriage form?

2.) 10Y Travel History Excluding the UK: For the travel history for the UK asks for the "arrival" date. 10Y travel history is asking for the "travel date." I've had several overnight flights would I enter the date of departure from my country or the date that is stamped in my passport?

Below I've included the Sponsor, the Employer and the Landlord letters. Would you guys be willing to proofread them?

Thank you in advance for all the help.  :D

I am writing to confirm sponsorship of my wife {Name} for a Spousal Visa to join me in the UK. I am a British citizen and I have lived in the UK since birth.

Currently, I am employed full-time by {Removed} Ltd as {Removed} Manager, and have been employed here since 11/09/17. I first met {Name} in Santa Cruz, California 03/09/12, whilst I was visiting the USA on a work permit, and again in 14/09/13 in Lake Tahoe, Nevada. We made our relationship official on 01/12/13. Whilst apart, we stay in touch daily via Viber App text, phone-video calls, Line App text, phone-video calls, email, Facebook Messenger. We are providing communication history covering our entire relationship over the above mentioned platforms. Line App shows usernames versus actual names, {Name} is my username. We lost our call log history from 12/13 to mid-2015 when we were using Skype. Lastly, we had stopped using Facebook Messenger between 08/15 – 10/16.

Dear Sir/Madam,

RE: For the attention of the Entry Clearance Officer, Ref Name and Name.

I am the landlord and owner of the rental property at address: {removed}

I confirm that Name has lived in the property since May 2017, and has signed an assured shorthold tenancy agreement. I confirm he has never missed a month’s rent.

The property is a 3-bedroom flat, with a separate living room, kitchen, bathroom and toilet.

There are 3 tenants living at the property, name, name and name. All three tenants are named on the joint tenancy agreement, and each tenant occupies their own bedroom. All tenants have use of the shared living room.

Subject to satisfactory Right to Rent and Right to residency checks, I have no objection to accommodating name, the spouse of name. There is more than adequate space for the fourth person in accordance with the Housing Overcrowding Act.

Furthermore I have had confirmation from Name council that I am not required to have a mandatory HMO, as my property does not fall within that housing category.

Should you have any further queries, please do not hesitate to contact me on

Not sure about your question, I'm afraid.

But in regards to your sponsor letter, the relationship part looks way too long to me. I would condense it down a bit.

For example:

To the Entry Clearance Officer:

I am writing to confirm sponsorship of my wife {Name} for a settlement Visa to join me in the UK. I am a British citizen and I have lived in the UK since birth.

Currently, I am employed full-time by {Removed} Ltd as {Removed} Manager, and have been employed here since 11/09/17. I have included the rental agreement together with a letter from the landlord confirming my right to reside in the property and giving {Name} permission to live there.

I first met {Name} in Santa Cruz, California 03/09/12, whilst I was visiting the USA and we entered into a relationship on 01/12/13. Since then we have continued to see each other 2 to 3 times a year, with her visiting me in the UK X times, for between Y and Z weeks/months at a time, while I have visited her in the US A times, for between B and C weeks/months at a time. We got engaged in Paris on 05/09/17 and we married in City on 16/10/17. Whilst apart, we stay in touch daily via texts, instant messenger, video calls and email. We are providing communication history covering our entire relationship, as well as boarding passes/e-tickets for all of our trips to see each other. {Name} and I want to settle together in the UK to be close to my family and because we like the culture here.

The landlord letter also seems too long and detailed. Your rent payments are irrelevant as are the tenancy details. Overcrowding does not need to be mentioned (since with 3 bedrooms and a living room there can legally be 7.5 people living in the property before it gets overcrowded. You also do not need to mention anything about HMOs.

I'd go with something like:

To The entry Clearance Officer

I am the landlord and owner of the rental property at address: {removed} and I confirm that Name has lived in the property since May 2017, and has signed an assured shorthold tenancy agreement.  Subject to satisfactory Right to Rent and Right to residency checks, I have no objection to [applicant name] moving into the property once their visa has been granted.

Should you have any further queries, please do not hesitate to contact me on

Thank you @ksan24 for the suggestions. I'll work on editing the Sponsor and Landlord letters. The Employer letter is okay though?

Thanks again!

Actually, looking at it again, the employer letter looks a bit longwinded as well. I’d maybe make it less wordy and more straight to the point.

The first paragraph is fine, but for the rest, maybe:

I confirm that the following payslips submitted for the application are authentic, and issued by {Removed} Retail Ltd:

30/04/2018 – basic pre-tax salary of £{Removed} paid into bank account on 30/04/18 by: {Removed} LTD
Please note payslip is correct but, amount paid in was 20p less. Reason for discrepancy: input error/typo.

31/05/2018 – basic pre-tax salary of £{Removed} paid into bank account on 30/05 by: {Removed} RETAIL LTD

30/06/2018 – basic pre-tax salary of £{Removed} paid into bank account on 02/07 by: {Removed} RETAIL LTD
Please note the BACS date in is due to changeover to a new payroll system

31/07/2018 – basic pre-tax salary of £{Removed} paid into bank account on 30/07 by {Removed} LTD

31/08/2018 – basic pre-tax salary of £{Removed} paid into bank account on 29/08 by {Removed} LTD

30/09/2018 – basic pre-tax salary of £{Removed} paid into bank account on 27/09 by {Removed} LTD

31/10/2018 – basic pre-tax salary of £{Removed} paid into bank account on XXXX by XXXXXX

Please note salary has been paid from either {Removed} Retail Ltd or {Removed} Ltd. {Removed} Retail Ltd falls under the {Removed} group of companies, and the bank account used to make the payment has been chosen at the discretion of me as Financial Director.

NOTE: you are currently 1 month short on your payslips, as it’s the date printed on the payslip that matters... and the period May 31st to October 31st only covers 5 months. To meet the 6-month requirement, you will need to cover back to and including April 30th.

So, you will also need to include your April 30th payslip and corresponding bank statement, and have this one mentioned in the letter as well.

Thank you @ksan24 for your insight. We plan to include April’s payslip. For the bank statements they run April 6th - May 5th. So I planned to submit April 6th to November 5th. Which shows each of the payslip deposits. So would I need to include March’s statement to cover the 1st - 5th of April?

In the near future I’ll post my contents list to make sure I’m not missing anything.  ;)

No, you'll be fine with just the April bank statement :) (Sorry, did I miss that you already included it in the letter? I posted my reply on my phone at about 3am on a night shift)

Basically, your 6-month period is determined by the dates on your payslips, so you just need the bank statements to cover those same dates (and likely a bit either side)

As your latest payslip is dated 31st October, your 6 months will be 30th April to 31st October... therefore your bank statements need to cover all of those dates as well.

Which means you'll need to send:
Payslips:
April 30th - October 31st

Bank statements:
April 6th to November 5th (which will cover the payslip period of April 30th to October 31st).

Is it common for bank statements to skip dates when it falls on a Sunday?

I have April and May bank statements where a day/date is skipped (it is a Sunday) in the statement date range.

April's statement dates: 6th April - 5th May
May's statement dates: 7th May - 5th June

6th of May is left out. Will this be an issue? Something I have to explain or this is common and the ECO will understand?

Thanks.

I really don't know, I'm afraid. It's not a question/issue I've ever come across before.

Your cover letter looks good to me.
