Daughter's UK Passport

Hello everyone,

We are currently in the UK for a week and just about to go home tomorrow.

Just trying to sort out some paperwork we can do now.

My daughters UK passport which we have applied for back in April still hasn’t arrived.  They are now after 3 months, is asking for my husbands UK birth certificate, my daughters US birth certificate and a CENOMAR ( certificate of no marriage - from the Philippines as it’s my birth country).  I’ve lived in the US for most of my life and left the PHIL over 25 years ago as a child, but was able to somehow get one anyway thank goodness.

I was wondering would it be okay to use my daughters UK consular birth certificate as a proof of her UK citizenship or we still have to wait for the passport ?

Give them what they want -- the time to send in what you wanted to send has passed. Send in every last scrap of paper they have asked for and all will be fine. Don't send what they've requested, and you're risking refusal which could make the whole process more of a nightmare than it needs to be.

Were you married to the child's British citizen father when she was born? If not, you have to send more documents than if you had been married. I believe they can request DNA.

As divorce is illegal in the Philippines, you had to show you were not married to another man when the child was born because he would have been her father even if he was not her biological father.

That’s weird because I wasn’t asked to submit a CENOMAR even if I was a dual Philippine citizen at the time of my son’s birth, also born in the US.

That’s weird because I wasn’t asked to submit a CENOMAR even if I was a dual Philippine citizen at the time of my son’s birth, also born in the US.

It's not unknown for parents to be asked for further proof when they try to renew their child's British citizen passport.

Passports can be issued in error and having a passport does not mean they are a citizen, hence why passports can be  cancelled or not renewed.

Quite a few parents reporting recently that their child has had their British citizenship removed as they were refused another passport on renewal, when in fact they never had citizenship and the passport had been issued in error.

As physicskate has said, you will need to send them the documents they have requested for your daughter's British citizen passport.

The consular birth registration doesn’t prove anything unfortunately. You will need to wait for your daughter’s British passport.

I have to say, I'm a little confused about what you are asking.

Do I have this right?

- you applied for your daughter's UK passport
- 3 months later, the passport hasn't arrived yet
- In order to process her UK passport, they are now asking for your husband's birth certificate, daughter's US birth certificate and CENOMAR
- you have now sent all 3 of those documents to them?
- you are wondering if you can use her consular report of birth abroad as proof UK citizenship instead of her UK passport (which hasn't arrived yet) for some kind of application for something?

If you're applying for a UK fiance/spousal visa for yourself, you do NOT need to provide any kind of evidence of your daughter's UK citizenship anyway. So, you just need to make sure her UK passport arrives before she flies to the UK to live, so that she can enter the UK as a UK citizen.

So, you can go ahead and apply for your spousal visa without needing either your daughter's UK passport or her birth certificate or her consular report of birth abroad.

Yes that is what I am asking for Ksand.

We are hoping we get her passport before the application as when I do the online application it asks for her passport information.  Although I have her US passport, I would like to also have her UK.

For some reason if there is a delay again.  Can I use her US passport to the UK, and her consular birth certificate?

We are not looking to apply for another 2 months.  Hopefully we will have them by then.

You don't have to provide ANY evidence of her citizenship for your spousal visa, because she has nothing to do with your application.

You just need to enter her passport information into the form... and that's it. No need to use her consular birth certificate for anything.

So, you can just enter in her US passport information and then you can make a note that her UK passport has not arrived yet... although if you are not applying for another couple of months, you should have her UK passport by then anyway... so then you just enter the details of both passports into the application form.

You don’t need to. There is no requirement to register her birth in the U.K. or get her a U.K. birth certificate.

You can if you want, but it’s not necessary.

From that page:

You don’t need to register with the UK authorities but it means:

- the birth will be recorded with the General Register Offices or at the National Records Office of Scotland
- you can order a consular birth registration certificate

You can still apply for a UK passport for your child even if you don’t register the birth in the UK.
