Spouses job info
« on: November 24, 2018, 01:38:24 AM »
The online application requests my wife job information. Is this really necessary ? She really doesn't want her work to know she's leaving next year.
For the financial requirements she will be submitting her bank statements to show her 401K has enough to satisfy the requirements .
I am a UK citizen and we both live in the US but we're moving back to UK to retire and be closer to my family and friends.
thanks
Colin

She must complete her employment information as is true and correct on the date of application. It is just a formality though because her employment cannot be considered for the visa anyway (it’s your responsibility to meet the financial requirement to support her, though you can use her savings to meet it).

She does not need to provide any evidence of her employment, and her employer will not be contacted and will not be aware that she is applying for a visa.

The only reason the question is on the form at all is because the online form is generic and is pretty much the same for all visa types...and other visas (like visitor visas) require her to show ties to the US to return to (like a job and a home).

You then fill out VAF4a Appendix 2 with all the details pertaining to how you meet the financial, accommodation and relationship requirements for the visa.

Quick question:
Do you have Appendix 2 filled out, and every single required document in your hands and ready to submit to New York? She should not submit the online application until she is completely prepared for the visa and has everything collected and ready to mail for processing.

No problem :).

Filling out the online application should be one of the last things you do, when you’re completely ready to submit everything to New York... because the date you submit the online application and pay for the visa is your official application date and all your documents must be ready on that date (I.e. her most recent financial documentation (latest bank statement) must be dated no more than 28 days before the date she submits the online application).

She can keep saving the online application as she goes, but should not submit it until she’s ready to go.

Just to check that she has selected the correct visa type on the online application?

She needs to apply under:
Settlement -> Settlement -> Wife

Do you have your accommodation in the UK sorted out? You’ll need to provide evidence of it for the application.

What date are you actually planning on moving?

Her visa vignette will be made valid for 30 days from the Intended Travel Date she puts on the application form (or actually it’s usually made valid starting 7 days before that date), and the date she puts can be up to 6 months in the future (if that date passes before the visa has been processed, it will be made valid from around the time the decision is made instead).

When you have your documents ready, if you would like to post a list of everything you are including, we can check that you aren’t missing anything :).

Thank you for the useful information. We don't have a date to move yet, we've got our house here up for sale so that determines our departure.
I was thinking of getting the visa before the house sells and coming back to us after activating pithing the 30 day period.
I was going to give my sisters address for accommodation  until we find our own place.

That’s fine - a lot of people do it that way because of the uncertainty of when the visa will be issued and which 30 days you get for the visa.

You will need to put a travel date for the visa application though, so you’ll want to pick the earliest possible date you might wish to move, and that you know you will be able to travel within 30 days of.

Once she has entered the UK and picked up her BRP card, she can come and go as she pleases. The requirement for entering though is that you must either already be in the UK on the day she enters for the first time, or must be travelling with her and entering the UK on the same occasion. She can’t travel ahead of you/on her own while you stay in the US.

That’s a good option, and also something that a lot of people do as well :).

You’ll need to provide the following documents:
- your sister’s Land Registry document
- a letter from your sister giving you both permission to live in the property, along with confirmation it will not be overcrowded (by listing the total number of bedrooms + living rooms, and the total number of people who will be living there).

Optional extra:
- your sisters latest annual mortgage statement (if applicable)
