Oh dear, so it does sound as if your BRP was issued with the incorrect date then. You will need to get that sorted out.

Absolutely nothing to be a wreck about.  It's a pain in the ass, but will be sorted.  Do NOT lose any sleep over this.  They simply put the wrong date on your BRP.  It'll get fixed.  We had another member (Lyonaria) who's BRP said she was 100 years older than she is.  Seriously.  You can't make it up.  And she's sorted.  It'll just take a little bit of persistence (potentially) but it'll get fixed.

You will NOT:
Lose your job
Have to move away from your husband

Or anything else you are dreaming up.   ;)

Oh wow that’s terrible !! I’m happy to hear she sorted it !! You guys are amazing thank you so much !  I’m just hoping I have enough time to sort this and I’m not to late ..

I've just found the post where she talks about it. It was a long time ago though in immigration terms, her situation was not the same and the process was different then too. But the point is, she got it sorted! You've done the right thing already by filling in the online form. Hang in there!  :)

Honestly thank you girl so much !!! Giving me some hope !!  I also spoke to my HR rep today as well !! I’m thinking to give the MP office a call when I get back from the states after Christmas !

You can not be rejected because of the date you apply for FLR. You can actually apply at any time but we talk here about when best to apply only to avoid having to make an extra application on the way to ILR.

Please try to stop worrying (although I completely understand your anxiety). You will get this taken care of!  :)

As mentioned, they won’t refuse it on those grounds because you can technically apply for FLR(M) at any time during your current visa validity.

However, if you applied in April, your new visa would expire a few months before you could qualify to apply for ILR, so you would have to apply for another FLR(M) in 2022 to bridge the gap, which will cost you an extra £2000+ in visa fees (depending on what the fees are by then).

So if you can get your BRP corrected to the October date, it’ll make your life easier and you’ll save thousands in future visa fees.

Fingers crossed you hear back soon.

Current FLR(M) fees are £1,033 for the visa plus £1,000 IHS surcharge. The visa fee may increase in April though, but we likely won't know when or by how much for a couple more months.

You also have the option to pay an extra £800 for 24-hour processing, however since currently your visa expires earlier than it should, it would be better to use the regular, standard processing, which can take up to 8 weeks.

It can takes a few weeks to get a free biometrics appointment, so you might even be able to time it so that you could potentially qualify for ILR before the new visa expires. For example, say you applied just before the visa expired (say, April 23rd), but you didn't schedule your biometrics appointment until, say late May, and then it did take the full 8 weeks to be processed after that, your visa would be issued in late July and would be valid until late January 2023... and if you entered the UK in early February 2018, you could apply for ILR from early January 2023, meaning you might have a small window in January where you could apply without needing to renew the FLR(M) a second time.

However, there's no guarantee that the timeline would end up working out that way, so hopefully you can get the spousal visa corrected to expire in October instead :).

Oh wow so even if the visa say it expires in April I can apply before then but still have the 8 weeks open and I can still work and use the NHS during the 8 week period without it interrupting my work schedule ?  This is really good information as always I will consider the 8 week processing times if nothing is correct with in the next 2 months
