You can apply from 28 days before the 2.5 year anniversary of the date you entered on your spouse visa, but must do so before your BRP expires.

https://www.gov.uk/government/publications/apply-to-extend-stay-in-the-uk-as-a-partner-or-dependent-child-form-flrm

The application costs £1033 and it's £1,000 for the IHS.

Are you sure your BRP expires in April?

Looking at your previous posts, I see your visa was granted at the end of Jan 2018, which means it should not expire until end of October 2020, which is a visa validity period of 2 years and 9 months

I also see that you arrived in the U.K. at the beginning of February 2018?

In that case you will not reach 2.5 years in the UK until the beginning of August 2020, and therefore the earliest you can apply for FLR(M) is early July 2020 (28 days before the date in August you reach 2.5 years). The latest you can apply is the expiry date on your BRP which should be late October 2020.

Hmm, that’s concerning because that means it’s not valid for long enough for you to be able qualify for ILR on the next FLR(M) visa! I’m not sure if there’s anything you can do about it now can as it’s something that should have been corrected before you moved to the UK.

If you entered the U.K. early Feb 2018, then you will qualify to apply for ILR in early Jan 2023. However, your FLR(M) will only be valid from around April 2020 (or whenever it is issued) until around October 2022.. which will make you 3 months short for applying for ILR. Which means you would need to apply for another FLR(M) in 2020 to make up the 3 months before you can apply for ILR.

I don’t know if anyone else has any suggestions for what you can do.

Now I’m really concerned and kinda scared .. I did everything like I should of done .. I’m gonna be freaking out .. can they kick me out of the country if I apply to soon or to late ? I dunno what to do

If we've established that a mistake was made on the BRP, I would fill in the online report as if it was one which was recently issued. I don't know if it will do any good or not (as we are told to check all that information on receipt) but it certainly won't hurt.

If that's not successful, I'd take it to the MP. It's just too much money for another FLR and IHS to give up without a fight!

OP Don't worry, if all else fails and they don't make the correction, it's just a case of an extra FLR. It's expensive and you will want to try to avoid  the extra application but that would keep you legal and in the country.

Can you just confirm both dates on the BRP please?

And please don't panic, you won't have to leave. The fight I mentioned was just to get your BRP corrected at this late stage, not that you'll have to fight to stay here.

You have plenty time to sort this out before April.

What residency card? Your BRP is your visa.

The residence permit card they give you with your picture and right to work .. that says valid until  24th of April 2020 but the paper says 28th of oct 2020

How can I upload a picture ? I’ll send it !!

Oh dear, so it does sound as if your BRP was issued with the incorrect date then. You will need to get that sorted out.
