Non-US Spouse Travelling to USA
« on: July 29, 2020, 09:26:44 AM »
Hi all,

Been off the forum (and the internet as a whole) for a while! Feels great.

However, need some information.

American Airlines are offering the chance to change flights up until December 31st 2021 if you book by 31st July. We have a family wedding that we were due to attend in July but has moved to November 24th. Obviously it presents an opportunity to visit family for thanksgiving.

At the moment, British people are banned from flying to USA. This would mean I (British citizen) could not attend with my wife and child (US citizens)

However, I've read in some loose articles that direct non-US family members can fly with American spouses. Does anybody know if this is the case?

Thanks in advance

The official declaration from the US government is that foreign spouses of US citizens are allowed to enter the US.

From the UK government website (https://www.gov.uk/foreign-travel-advice/usa/entry-requirements):

Entry rules in response to coronavirus (COVID-19)

Entry to USA

Since 16 March, it is not possible for many British nationals to enter the USA if they have been in the UK, Ireland, Schengen zone, Iran, Brazil, or China within the previous 14 days.

US citizens and permanent residents of the USA, certain specified close family members and certain other limited categories of visas holders (such as UN staff and diplomats) are exempt. They will still be able to enter the USA, subject to normal entry requirements.

It also says:
Quarantine requirements
Those allowed entry to the USA must be prepared to self-isolate for up to 14 days after arrival.

From the travel.state.gov website regarding the US Presidential proclamations on coronavirus:

On Monday, June 22, President Trump signed a proclamation suspending entry into the United States of certain immigrants and nonimmigrants who present a risk to the U.S. labor market following the coronavirus outbreak. Effective immediately, the proclamation extends the suspension of entry for certain immigrants (Presidential Proclamation 10014) through December 31, 2020. The new restrictions imposed by the proclamation are effective at 12:01 a.m. EDT on Wednesday, June 24 and expire on December 31, 2020, unless continued by the President.

U.S. citizens are not subject to the proclamations.  All proclamations provide exceptions to the restrictions for lawful permanent residents of the United States.  Some exceptions include, but are not limited to: foreign diplomats traveling to the United States on A or G visas and certain family members of U.S. citizens or lawful permanent residents including; spouses, children (under the age of 21), parents (provided that his/her U.S. citizen or lawful permanent resident child is unmarried and under the age of 21), and siblings (provided that both the sibling and the U.S. citizen or lawful permanent resident are unmarried and under the age of 21).  There is also an exception for air and sea crew traveling to the United States on C, D or C1/D visas.  For the full list of exceptions please refer to the proclamations

Thank you!

It's Pennsylvania so hoping cases there remain fairly low
