Testamentary Trust & 3520

It is common for Testamentary Trusts to be incorporated in even the most simple U.K will. How does the IRS treat the transfer by reason of death to a trust. With U.S beneficiaries or U.S Trusties and the decedent's estate?

With USC's having U.K wills and solicitors dealing with U.S and U.S Residents foreign estates, this would be a common but complex issue.

I don’t know the answer but am interested in any answers.

My wife and I do have U.K. wills leaving our estate to our 2 children when the last of us dies, but no Trust. Both children are USCs.
Dual USC/UKC living in the UK since May 2016

As a default and as set out in STEP, trusts are a part of wills. You would have specifically had any will written to avoid this
