CRBA Required for Tax Refund?
« on: April 09, 2021, 12:02:19 PM »
Hi all,

As Biden laid out there will be an extra $1,400 for children born in 2021 which will be refunded in April 2022.

My question is, what happens if a child is born abroad without a CRBA? Obviously the American embassy is only doing emergency appointments at the moment with a huge snowballing backlog. We're due our second in August 2021 but will the baby officially not be a US citizen until a CRBA is done? Am I right in thinking that? And, if so, does this mean we cannot claim?

Any help or guidance would be appreciated.

TIA

If a child is born to a American parent qualified to pass down US citizenship, then the child is a US citizen, with or without the CRBA.

For a US tax return, any child included on that return for tax purposes must have an SSN.

You will need baby’s social. There will be a GIGANTIC backlog when things reopen.  Considering kids passports only last 5 years and the embassy has been closed over a year....  it’s going to SUCK.

You can amend the return when you get the SSN.

Thanks all, as I thought. That's a bummer but I hope it can be rectified much much later than the tax deadline.
