Is the statement of being able to start the visa process based on 28 days prior to the 30 months from the issue date on the BRP? or is it based on the 30 months of being in the country?
It’s 30 months of being in the country so you count from when you entered the U.K…. Which means you can apply from mid-January 2022.
Question number 2. If I choose to renew at the earliest possible time (which is about now? ) are there any downsides to this? As in, when it comes time to get my ILR after being in the country 60 months, the extra time by dragging out the first FLR would give me extra time after 60 months to apply for ILR.
(I hope that makes sense).
It depends on whether you use standard processing (up to 8 weeks) or £800!Super Priority processing (a decision within 24 hours of biometrics).
If you use standard processing, it doesn’t matter too much if you apply right when you are eligible because it will take a few weeks for the visa to be processed anyway.
But for Super Priority, it’s better to wait longer before applying so that you get more time to apply for ILR.
Bear in mind that you only need to submit the online application up to 28 days before mid-February… you can always book biometrics for a few weeks later if you want, which will buy a bit more time for ILR as well.
Question 3. Which is really an urgent one at the moment, Looking at my passport today it expires in the beginning of May 2022 ~ 4 months away. I haven't seen any information on how much time is required to be left on the passport before it expires to apply for the new Visa? I'm going to start the passport application on Tuesday to get that going.
I don’t believe there is a minimum time for the passport to be valid when applying for the visa, as the visa is issued as a BRP card - so once the visa has been granted, when you renew your passport, you just give UKVI your new passport number so they can update your details in their system.
Having said that, it should only take about 3 weeks for your US passport renewal, and you can apply for FLR(M) at any time between mid-January and your visa expiry date in April, so you have plenty of time to renew your passport first and then apply for FLR(M).
Question 4. We have a tenancy agreement from when we first came over, it was an agreement for six months (We didn't plan to stay as long as we have, the pandemic stopped us from looking initially). Is the expired tenancy agreement still valid as I was reading if we mutually stay at the property, it will become a rolling month-month lease, with a two-month end notice period from the landlord, or a one-month notice period from us as tenants?
So the question is, is the expired tenancy agreement acceptable? or do we need a supplemental letter as well?
If it states in your tenancy agreement that it becomes a rolling monthly contract after the initial 6 months (which it normally will), then you just provide the original tenancy agreement, which is still valid.
If the tenancy does not mention the rolling month-to-month, you’ll need to provide the original tenancy plus a letter from your landlord confirming that it has now become a rolling monthly contract.
Also, if your tenancy agreement is not in both names, you’ll need a letter from your landlord anyway, confirming that you still have permission to live there.
