My visa is Expired now due to 90 days out of UK

SO they said i should re apply.

Should i say my hubby and i were seperated?
we are still married.
  How likely should I get another visa?

Who told you that your visa expired?  What does it say in your passport?  Sometimes government officials aren't always the most knowledgable about their own rules as well as I am sure Victoria S has some advice on it.  But again, your FRL should be good until it expires, no matter what you do, it would be your IRL that might be difficult because of the extended stay apart.

The lady I been corresponding with told me that since i been out of the UK for 90 days, My Visa is now expired. It makes sense. I rather just go ahead and re register anyway. THen i get the full 2 years back. And we are fine with that.
 THE PROBLEM IS THIS! I NEED HELP suggestions. What to say if /when i know they will ask why i was out of the country for more than 90 days. Should I say we were seperated? or just say we were going through some things that made us need a break? like what would you thinik they would accept?
  Do yout hink i would have a hard time getting another Spousal Visa? I dont think it would be hard because I am going back to the same place  and I haven broken any laws whilist in the UK. and i worekd and stuff. WHich i will be supplyign all that info.

 

What visa do you have and where did you get it?  I can't think of a single visa which expires after 90 days out of the UK unless you got it in the US and left it over 90 days before entering the UK and therefore validating it.

You are correct. I did recieve my visa in the USA. It is a Spousal visa for 2 years. I  was out of the UK for 90 days  by June 22nd my visa has now expired. SO YES i have to re apply. I rather do that then fly all th way there, waste money and then they send me right back here and i not see hubby :-(

You never entered on your FRL-M, meaning you never got it validated by entering the country?

I am scratching my head with Victoria, because if you entered on an FRL-M, which would be good for two years and then left the UK, your FRL-M would still be good for two years, though you might have trouble getting an IRL based on your 90 days out of country.  Something is strange here...

Shala, could you perhaps put a time line up so people can see the exact dates and be able to help you more.
I know you lived in the UK for a while, didn't you?  Was that for about a year?

Shala, definitely double-check this before you waste time and money reapplying.  If I remember your situation correctly, you entered the UK on a spousal visa and were here for quite a while before you went back to the US.  Your spousal visa is good for two years and it's during those two years that you build evidence to apply for your ILR.  The spousal visa, to my knowledge, won't expire just because you've been back in the US for an extended time -- where you may run into trouble is when you apply for ILR because you'll need to prove that you and Patrick have lived together for the duration of your spousal visa (though you can worry about that when the time comes -- it can be sorted).

I just want to do everything properly.
 I dont want to be sent away again before i even get back.
 
I lived in London from June 24,2005 till march 18,2006
and i been gone since then.

And when you lived in the UK at those times, was it on your spousal visa?  And what is the expiry date of your spousal visa?

I was there on spousal visa. The visa was issued to me with the start date of June 22,2005  and expiery date is June 22nd 2007
  However i guess since i have been out of the contry for 90 days  i am expired. meaning i am sure i would send a red flag up traveiing back to the UK . Thats not good and thank GOD i know that now.

Trying to get my head around this.  Is this correct?

I'm in the UK on a work visa.  I have been out of the UK twice for longer than 90 days (for work + personal/family stuff).  They've never batted an eye when I came through immigration into the UK.  I was told (by either Victoria or Garry on this forum), that these absences will only be an issue when I go for my ILR or citizenship. 

Not to second guess you but I would hate for you to pay more ££££$$$$$ and spend more time getting a new spousal visa if you don't need one.

You are right on the money on the timeline.
however thats waht i waas told by an Officail at the Office. I dont want to get a NO on my ILR tho  so thas why i am thinking if i jut get anotehr visa it would be okay.

You have been fed an absolute crock of sh1t.  Your visa is still valid.  You might be asked on entry why you were out of the UK for more than three months, in which case be honest, and you will have no problems.  You do not need a new visa, and if you tried to apply for one you would be laughed out of the consulate.  I cannot emphasise enough - you have a perfectly good, valid, splendidly tickety-boo visa to come back to live in the UK.
