Wow..i have spent most of the day on here reading other posts and on some other sites as well.it seems to me it would be so much easier if we just get married here...sooo if we take that route..since he will not be staying after we are married can he apply for a visitors visa to the US or dos he still need to apply for the fiance visa?

He almost got bounced last time he came in March of this year because he had come too often on a visa waiver. Will he have to wait 6 months to come back on that again or longer? Or do I need to go to a different website for these answers?

Technically, he can get married in the US on just a visa waiver, but since he has had problems with entering on the visa waiver in the past, it may be worth him applying for a visitor visa (someone else may know more about this). Unless he plans to live in the US with you and not return to the UK at all, he should not apply for a fiance visa to the US. For one thing, I've heard that it can take several months for the US embassy to even issue a fiance visa ((4-6 months is the average, I believe - compared to a couple of weeks or so for a UK spousal visa for you to move to the UK) and also, if he's not planning on living in the US after the wedding, then he's not really eligible to apply for a fiance visa anyway.

hi there im living in uk my fiance is in the states she had the same problem applying for a marriage visit vis to come and marry me in the UK,she did not provide any documents they gave the exavt same reasond for refusal because she aplied she did not think that any supporting documents would be needed and yes you cannot appel what we did was made a new application with the supprting documents job letter,job letter sating you will come back jon the job,previous divorce decrees,phone bills copies of both people,in terms of arrangement you can give the address of the registry office where you plan to get married you can give an approximate date because you cannot have a sure date until you are in UK,my fiance got her visa today and coincidentally her flight is booked for the 8th of september as well.make a new application as soon as possible with the supporting documents attach a letter explaining why you cannot provide any document and yes very important get your fiance UK passport copy or whateveer he has over there,my fiance made a new application three days after being refused the first time and she got the visa in four days you will have to go for the biometrics again,hope this helps.email me if u need more info

We are now definetly going to get married here in the US.
Does anyone know how long he will have to wait to come back on the VWP? They told him last time at customs that he was abusing the VWP by coming so often and staying so long..he was basically here 6 months out of the year in 3 month intervals.

Also, I just finished talking to him, and he suggested that I reapply for the visitor visa but without the intent to marry so that I can still go and see him! Is this probable since I have already once applied for the MVV?

have you thought of getting married in a third country, like Canada?  That would likely alleviate immigration hassles when it comes to actually entering the country to see each other.

Eventually I will be moving to the UK permanently, but it will be several years as I have 2 young childen and he has a 12 year old son there ..hence our dilema!

Its so very frustrating..you wait all of your life to find this kind of Love and then you have to move heaven and earth to be together!!  :\\\'(  Crazy as it is, and frustrating as it is, we are not willing to let go!

If you don't plan on living together for several years yet, is it even necessary to get married right now? Or did I just get the wrong end of the stick?  ???
I'm thinking about getting metal legs. It's a risky operation, but it'll be worth it.

Reading that you may not move to the UK for a few years...I'd say it'd probably be best to wait until you can move to get married. My husband and I were in a long distance relationship for almost 8 years before we got married - while it was hard, I found the few months after we were married the hardest.

If it's an option for your fiance to move to the US, I'd say perhaps either a fiance (K-1?) visa for the US would be the best. Or if you reapply for the MVV with the needed letters/documents, then you can go back to the US and apply for I think it's the K-3 that's a spousal visa for the US. I know the waiting and processing time (and the process in general) is longer and more complicated though.

Good luck deciding which is best - a lot of us have had to do it and it does suck but once you have a solid plan it seems a lot easier and more attainable (sp?)

You do realise that having an American spouse will likely result in the immigration officer being even MORE critical of him as he tries to enter the US?  Having a US spouse is seen as one less reason for him to leave at the end of his stay.

It took my husband 3 years after applying for the I-130 Change of Status for him to be given his Green Card and during that time he was not allowed to leave the United States.  I do believe that this 3 year wait was very out of the ordinary and it was during the 9/11 time period which seemed to push a lot of deadlines into even longer waits.  But I do know that the US Immigration process is MUCH MUCH longer than that of the UK's and at least Eight Years ago you were not allowed to leave while it was in process.
11 Aug 00 - Married (Living in US)
25 Jul 08 - Spousal Visa w/ KOL Stamp Approved
01 Oct 08 - Arrived in the UK
05 Mar 09 - ILR Approved (In Person Appointment ~ Liverpool Office)

...and if he gets *caught* entering the US on the VWP with the intention to marry you and stay by filing the I-130 from the US, he faces a ten year ban.

This is not a good plan.  He cannot enter on the VWP with the intent to stay.

If that's the case, you need to go through the K-1 visa process and then file for adjustment of status once he's here on that visa and you're married.  Gwen is absolutely right- it's illegal to enter the United States as a visitor with intent to immigrate, which is what he'd be doing.

Ok..thank you. Is the K-1 difficult to obtain? How much is it? My fiances internet is down so I am trying to get all the information for both of us!
