Getting ready to apply
« on: July 26, 2009, 05:08:47 PM »
Hi Everyone!

Thanks for the great site. Its been so helpful and the responses quick and informative.

So here is my story....I will be applying this week for my spouse visa.

I recently got married to my wife here in the states. I've known her for over a year. She was born in England and still resides there.

She returned home a few weeks ago and has sent me her notarized/certified (by a solicitor there) documents.

She has sent the following
mortgage statement
passport
employer id
bank statements
P60
etc....

I have all my original documents as well as certified marriage certificates and they are all in order.

Just looking for opinions or suggestions or thoughts from people who think there will be a problem.

Thanks in advance

Jim

Jim, in order to pass the accommodation test you need to show that the accommodation you will occupy with your wife is "suitable" and certainly not overcrowded.

Does your "etc" include anything about the property?

I think we'd need a lot more information about your situation to tell if there may or may not be a problem.

Do you have a complete table of contents?
Are you familiar with the maintenace requirements?

Its a 3 bedroom house. Nobody else lives there but her.

Its usually suggested that you inlclude a complete Table of Contents with your application to lay out what documents you are including.  Basically, just an organized list of your supporting documents.

Take a look at this to see what I mean by maintenance: http://www.ukvisas.gov.uk/en/ecg/maintenanceaccommodation#17693600

Your wife must show that she can support you as a couple at least until you get a job and can add to the income.  If you have savings, this changes things a bit as this can take place of any shortages in income.

Thanks for confirming that, but are you going to tell the ECO looking at your visa application?

Table of Contents? Please expand your "etc" in your list so that we know all you are proposing to submit.

I dont how how I would tell them. Is there a document that would prove this?

I will put together a Table of Contents later as I'm just creating that now. Is there any template I should follow?( on the good advice I just got today!!!)

I just found this on www.ukvisas.gov:
'Sponsorship Undertaking Form (SU07)
If you are applying for settlement as the parent, grandparent or other dependent relative of someone in the UK, your sponsor needs to complete and sign the Sponsorship Undertaking Form (SU07) below. By signing this form, your sponsor confirms that they will be responsible for your maintenance and accommodation in the UK. You should include this completed form when you make your settlement application.'
I am also applying for a spousal visa. Is my husband considered a 'dependent relative' since he will be sponsoring me? I didn't realize we needed this form along with all of the supporting documents.

He is considered your sponsor for your spousal visa.  The form you are referring to, I believe, is one you would use if your parents or grandparents wanted to come live with you because they were dependent on your financially/medically/etc.

That information should be on the deed to the property.

The mortgage statement that you mentioned in your original post will show that she owns the home. She should then mention in her supporting letter (a letter that shows she is on board with your application) that she owns the home, lives there alone and that you plan to live there together after your visa is approved.

Jodie - the form you found is irrelevant for spousal applications. Dont worry about it.

JimD: Do you have a letter from your sponsor (i.e. your spouse) saying that they wish to sponsor you for a spouse visa?
