Hello everyone...

so my settlement visa was denied due to the fact that they wanted more evidence of our relationship, his settlement status in the uk, a more recent lease agreement, my itineraries and photos of us.

I have since resubmitted an appeal. and am waiting on the response.

my questions are:

1) can i travel to london while waiting for this appeal to visit my fiancé?
2)I have a canadian passport, do i need a visa?
3)has anyone gone through the appeal process? how long will it take?
4) would it just be better for me to reapply? if so does anyone have suggestions as to whether or not there is an agency I can use? (i cannot really afford an immigration lawyer)

I am desperate please help.

If you want to, you could start a new thread and post the exact wording of the refusal letter (personal details redacted) for feedback more tailored to your exact situation.

From what I've heard, appealing can be lengthy, and if something easily remedied was the problem (like missing documentation), it may be quicker to just re-apply and address the issue.

We recommend that if you've been refused a visa, you gain prior entry clearance before visiting the UK again.  Otherwise, you may be denied entry and you'll have wasted the money spent on the plane ticket.

I was not the one that made my application my Lawyer did from the UK... I have no choice but to sit and wait... she was out of the office so we were going to call her on Friday to find out if she got an Email...

Good luck to you. I know how frustrating it must be. Mine showed up in the post without any email from the consulate, and it was an approval, so hopefully it will be the same for you.
Sept 2, online application
Sept 9, biometrics appointment, purchased priority & sent package to UK Consulate NYC
Sept 12, package delivered 9 am, email of receipt @2:56pm NY Time
Sept 15, passport arrived in the post with visa.

Awwww thanks you just made me feel alot better thought it might be a refusal since it was just sent well guess only time will tell lol checked its out for delivery they said by 10:30am so im posted infront of the door lol

Applied to the New York office.

23rd December - mailed out UPS standard mail (but Worldbridge Expedited Service)
29th December - Recieved email saying recieved
30th December - Received email saying issued
2nd January? -    Recieved package back with Visa
21st January -    Flew into Heathrow. : D

That seems very odd since you applied less than three months after your wedding.  Would you mind posting the exact wording of the letter, personal details removed?

I sent the letter to my Lawyer in the UK today right after getting it so I can't word it exactly but what it said was We recieved your application on December 2, 2011 you have given us proof of your wedding taking place on September 23, 2011 and your spouse stayed for 11 days with you, however you have not shown any proof that you have seen your spouse again since your wedding.

It was also the fact that my legal name and Facebook name are two different names and my Legal documents state that I live in Philadelphia but my Facebook says that I live somewhere else.

Either way for everyone asking yes we are Appealing my Laywer and Husband will are planning on attending the Oral Hearing

Well considering you don't have to see him since I don't see why you would.  Maybe they mean intervening devotion, in which case you have to send them proof you've remained in contact, did you do that?
