Hi

I've been reading these threads for some time and have found them really helpful.  Congrats to everyone who has had their visas approved!

I thought I would contribute to the thread given my husband and I are on our second uk spouse visa application.  The first one was rejected due to making the application in-country (we didn't know he couldn't make an in-country application on the visa he was on at the time).  We met all of the other requirements.

He made the second application in Los Angeles and I have a daughter who is my husband's step-daughter.  We have been a family since August 2014 with him being closely involved in my daughter's care since then.  We initially got together in Dec 2012 and married in April 2016.

We used an immigration lawyer for the second application (but not the first).  I am a contractor working through a limited company so I made the application on the basis of me being self-employed (i.e. earnings as stated in company tax return).  Our timeline is:

Type of application:  Priority
Date of online application:  12 Dec 17
Biometrics appointment: 15 Dec 17
Date documents received in Sheffield:  22 Dec 17
Decision email:  Still waiting
Documents returned:  Still waiting

Good luck everyone!
Date of application:  12 Dec 17
Date of biometrics:  15 Dec 17
Date of receipt of docs:  22 Dec 17
Not straightforward letter/request for docs:  23 Jan 18
Decision made email:  15 Mar 18
Decision:  Approved! 19 Mar 18

I submitted my priority settlement application on 24 December and received the Sheffield confirmation email on 28 December. On my application I just randomly chose and wrote 15 March as my intended travel day. Will this mean my visa application will not be approved or looked at until closer to then? I still have not heard anything back from UKVI, and I’m concerned I did myself over by not submitting a sooner travel date on my application.

No, because they will not see what date you requested until AFTER they pick it up to make a decision.

Almost the entire processing time is your application sitting in line waiting for someone to pick it up and look at it. While it is waiting in line, no one knows what travel date you put.

I still have not heard anything back from UKVI, and I’m concerned I did myself over by not submitting a sooner travel date on my application.

You’re only on business day 17 today... that’s well within normal processing times for the December applications.

However, if you put a travel date of March 15th, your visa will likely start somewhere between March 8th and March 15th, even if it is processed in January... they are supposed to honour the travel date, since you only have 30 days to enter and you requested that your visa should start on that date... though lately they have been making the visa valid starting 7 days before the date you put.

So it may well be the case that even if you get your visa in January, you won’t be able to move to the UK until March anyway because the visa won’t be valid until then.

Ideally you want to put the earliest possible date you know you will be able to travel to the UK within 30 days of. If that date passes before the visa is granted (which happens often) then it will just be made valid from when the decision is made or a few days later.

Katie_France-

Our hearts break for you both. We cant imagine what you must be going through. Be strong and let love be your rock.

NWKH

Thanks @nwkh Well, we are definitely very upset... Especially that it's done because of ECO's mistake, we feel as if we are just used to be milked for money... No responsibility at all... We have consulted a lawyer, and the opportunity to be stuck in the legal limbo for the 6-12 month is very high, so we decided to follow the marriage in the USA, and reapply for a spouse visa then.

I just want to wish you the very best of luck! You're currently living out one of my biggest worries and I truly feel for you. Congratulations on your upcoming marriage and best wishes going forward. It will all be worth it when it comes together!
